Waiver & Release Agreement

I acknowledge that driving to and from the river, whitewater rafting, wilderness hiking, and wilderness camping have inherent risks, hazards and dangers that cannot be eliminated. I understand that these risks, hazards, and dangers, which may arise from foreseeable and unforeseeable causes, INCLUDE, BUT ARE NOT LIMITED TO:

  • Certain river, road, vehicle, and land surface/sub-surface conditions
  • Collision with other objects
  • Malfunctioning equipment
  • Hiking in rugged country
  • Encounters with wildlife, animals, or insects
  • Contact with poisonous plants
  • Allergies due to wildlife or plants
  • Temperature and weather extremes
  • Falling out of a raft and drowning
  • Variations in terrain such as creeks, water, bridges, traveled roads, stumps, forest growth, debris, rocks, cliffs, and other obstacles, obvious or not, man-made or natural
  • The potential of any participant to act in a negligent manner, or to not act within his/her ability, that may contribute to injury to themselves or others
  • The potential that a guide may misjudge terrain, weather, trail or river routes, and water level
  • The unavailability of immediate medical attention in the case of injury
  • and ANY OTHER such risks, hazards, and dangers that are integral to recreational activities that take place in the wilderness or outdoor environment

I, on behalf of myself, my personal representatives and my heirs, hereby voluntarily agree to release, waive, discharge, hold harmless, defend, and indemnify Wild Science Explorers and Wilderness Science Education, Inc. and their board of directors, agents, officers, and employees from any and all claims, actions, or losses for bodily injury, paralysis, property damage, death, loss of services, or otherwise which may arise out of my use of rafting and camping equipment or my participation in rafting and camping activities.

I understand that I am releasing, discharging, and waiving my claims or actions that I may have, presently or in the future, for the negligent acts or other conduct by the owners, agents, officers, or employees of Wild Science Explorers and Wilderness Science Education, Inc.

Wild Science Explorers and Wilderness Science Education, Inc. has my permission for complete usage of all photographs taken by Wilderness Science Education, Inc. Student names will never be included without prior parental consent.

I am in good physical health and have the ability to safely engage in whitewater rafting and wilderness camping activities.

I HAVE CAREFULLY READ THE WAIVER AND RELEASE AGREEMENT, CLEARLY UNDERSTAND IT, AND BY VOLUNTARILY SIGNING IT, I AGREE TO ITS TERMS.

Indemnification

(Must be filled out by a Parent or Legal Guardian of participants under the age of 18)


I, ________________ (Parent or Legal Guardian), in consideration for the above minor being permitted to participate in whitewater rafting, wilderness hiking, and wilderness camping, agree to the following waiver, release, and indemnification:

I, for myself, and on behalf of said minor, agree to hold harmless, indemnify, and forever defend Wild Science Explorers and Wilderness Science Education, Inc., their directors, officers, agents, employees, and volunteers from and against any claims, actions, demands, expenses, liabilities (including reasonable attorney fees), or negligence as a result of said minor's use of rafting and camping equipment or his/her participation in rafting and camping activities.

I, for myself, and on behalf of said minor, further agree not to sue Wild Science Explorers or Wilderness Science Education, Inc. as a result of any bodily injury, paralysis, property damage, death, loss of services, or otherwise that said minor suffers in connection with his/her participation in whitewater rafting, wilderness hiking, and wilderness camping during Wild Science Explorers and Wilderness Science Education Inc.'s outdoor science programs.
